Effective Date: 11 November 2025
This Privacy Policy Agreement (“Agreement”) is entered into by and between:
Gogunda Palace, having its principal place of business at Rajputon Ka Mohalla, Gogunda, Udaipur, Rajasthan 313705, India (hereinafter referred to as “Hotel”, “we”, “us”, or “our”),
AND
The individual accessing or using the Hotel’s services, website, or facilities (hereinafter referred to as “Guest”, “User”, or “you”),
(each a “Party” and collectively, the “Parties”).
RECITALS
WHEREAS, the Hotel operates a hospitality business providing accommodation, dining, events, weddings, conferences, spa services, and related facilities, as well as an online platform at www.gogundapalace.com (the “Website”);
WHEREAS, the Hotel collects, processes, and stores personal information of Guests for purposes including reservations, check-in/check-out, billing, service provision, events, marketing, and regulatory compliance;
WHEREAS, the Guest desires to understand the Hotel’s practices regarding collection and processing of personal information and consents to such processing as described herein;
NOW, THEREFORE, in consideration of the mutual covenants contained herein, the Parties agree as follows:
ARTICLE 1 – DEFINITIONS
1.1. “Personal Information” means any information relating to an identified or identifiable natural person, including name, contact details, payment information, guest preferences, and other identifiers necessary to provide the Hotel’s services.
1.2. “Sensitive Personal Information” includes information requiring heightened protection, such as health, dietary, or mobility information, collected only where necessary to provide services safely.
1.3. “Processing” means any operation performed on Personal Information, including collection, storage, use, disclosure to authorized third parties, retention, or deletion.
1.4. “Services” include all offerings of the Hotel, including accommodation, dining, events, conferences, weddings, spa services, and Website-based services.
1.5. “Third Party” means any service provider or vendor engaged by the Hotel solely to facilitate Services, including payment processors, travel agents, event vendors, IT providers, or marketing agencies.
ARTICLE 2 – COLLECTION OF PERSONAL INFORMATION
2.1. The Hotel may collect Personal Information directly from the Guest for purposes necessary to provide its Services, including:

2.2. The Hotel may collect limited Personal Information automatically via the Website, such as IP address, browser type, device type, and pages visited, for operational and analytical purposes.
2.3. The Hotel may receive Personal Information from authorized Third Parties, such as travel agents or payment platforms, solely for the purpose of delivering Services.
2.4. Sensitive Personal Information is collected only when necessary for safety, health, or dietary requirements during the provision of Services.
ARTICLE 3 – PURPOSES OF PROCESSING
3.1. The Hotel uses Personal Information solely for purposes necessary to provide Services, including:
a) Managing reservations, check-ins/check-outs, payments, and billing;
b) Providing Services requested by the Guest;
c) Addressing Guest preferences or reasonable requests;
d) Maintaining reasonable safety and security within the Hotel premises;
e) Operating and improving the Website and Services;
f) Sending marketing communications, subject to Guest consent;
g) Complying with applicable laws, regulations, or contractual obligations;
h) Conducting necessary audits, risk management, or fraud prevention activities.
ARTICLE 4 – LEGAL BASIS FOR PROCESSING
4.1. Personal Information is processed based on:
a) Performance of a contract with the Guest;
b) Compliance with legal or regulatory obligations;
c) Legitimate interests of the Hotel limited to providing Services, safety, and operational efficiency;
d) Consent provided by the Guest for optional purposes, including marketing and analytics.
ARTICLE 5 – DISCLOSURE AND SHARING
5.1. Personal Information may be shared only as necessary to:

6.2. Guests may manage or refuse cookies via browser settings; however, certain Website functions may be limited if cookies are disabled.
ARTICLE 7 – RETENTION
7.1. Personal Information is retained only as long as necessary to provide Services or as required by law.
7.2. Personal Information no longer required is deleted or anonymized using reasonable measures.

8.1. The Hotel implements reasonable administrative, technical, and physical safeguards to protect Personal Information.

8.3. Guests acknowledge that no system is completely secure and that the Hotel does not guarantee absolute security.
ARTICLE 9 – INTERNATIONAL DATA TRANSFERS
9.1. Personal Information may be processed and stored in India or other jurisdictions necessary to provide Services.
9.2. The Hotel ensures compliance with applicable legal requirements when transferring data internationally.
ARTICLE 10 – GUEST RIGHTS
10.1. Guests may, subject to applicable law, exercise rights to access, correct, delete, or restrict processing of Personal Information, or withdraw consent for optional purposes.
10.2. Requests must be submitted using the contact details in ARTICLE 12.
ARTICLE 11 – CHILDREN
11.1. Services are not directed at children under sixteen (16) years of age without parental supervision.
11.2. Collection of sensitive information from children is conducted only with parental consent.

ARTICLE 13 – AMENDMENTS
13.1. The Hotel may update this Agreement to reflect operational or legal changes.
13.2. Updated versions will be posted on the Website with a revised “Effective Date.” Continued use of Services constitutes acceptance.
ARTICLE 14 – HOTEL-SPECIFIC PROVISIONS
14.1. Events and Weddings: Guest lists, dietary information, and photography/video consent may be shared only with vendors for service delivery.
14.2. Health and Safety: Sensitive information may be collected solely to ensure reasonable safety during Services.
14.3. Marketing: Use of images or video for promotional purposes will occur only with explicit Guest consent.
14.4. Loyalty Programs: Guest profiling is conducted only with explicit consent.
IN WITNESS WHEREOF, the Guest acknowledges acceptance of this Privacy Policy Agreement by using the Hotel’s services or Website.
